TERMS & CONDITIONS

1. Scope of Application

These Terms & Conditions apply to all agreements between dontshowgrandma (hereinafter: “Provider”) and its customers (hereinafter: “Customer”) regarding the rental of camcorders and the creation of edited wedding videos. German law applies exclusively.

2. Services

The Provider rents out camcorders (Sony HDR-CX405 and/or Sony FDR-AX43 AB) including EU-wide shipping and return.

Depending on the selected package, the Customer receives an edited highlight video, reels, and/or raw footage.

Delivery of the edited material is digital only.

3. Prices & Payment

Prices are as displayed on the website at the time of booking.

Full payment is required at the time of booking.

Bookings are confirmed only after payment has been received.

4. Shipping & Return

The Provider ensures the camcorder arrives at least one day before the booked event date.

The Customer must return the camcorder using the prepaid return label on the first business day following the event, unless a longer rental period has been booked in advance.

Proper packaging and safe return shipping are the Customer’s responsibility.

Risk of transport for the return shipment lies with the Customer. If the camcorder is lost, delayed, or damaged during return shipping, the Provider is not liable. In such cases, editing services cannot be provided, and no refund will be granted.

5. Late Returns

If the camcorder is not shipped back on the agreed date, a late fee of €45 per day applies automatically.

Customers may notify the Provider if they wish to extend the rental, but the late fee applies regardless of notice.

6. Damage, Loss & Liability

The Customer is responsible for any damage beyond normal wear and tear.

Normal wear includes small scratches or cosmetic marks that do not affect function.

Damage includes, but is not limited to: drops, impact damage, liquid damage, technical malfunction due to misuse, or missing parts.

In case of loss or irreparable damage (including during return shipping), the Customer is liable for the full replacement value of the camcorder.

A refundable deposit of €250 is charged and may be withheld to cover repair or replacement costs. If costs exceed the deposit, the Customer will be billed for the remaining balance.

7. Editing, Creative Freedom & Revisions

The Provider delivers the edited video within 4–6 weeks after receiving the returned camcorder.

The Provider works in its signature style: raw, messy, unpolished, and intentionally imperfect. The Customer acknowledges that artistic freedom applies and accepts that the final film may not resemble traditional cinematic wedding videos.

The choice of music is at the sole discretion of the Provider. All music used will be properly licensed for private use only.

The Customer is entitled to one round of minor revisions free of charge, provided that the revision request is made within 14 calendar days after the delivery of the download link.

After this period, no free revisions will be granted.

Any additional revisions or revision requests made after this 14-day period are subject to a fee of €150 per revision.

The Provider is not responsible if the footage supplied is insufficient (e.g., too few clips recorded, poor lighting, filming errors). In such cases, the film will be created to the best of the Provider’s ability using the available material, and no refunds or additional liability apply.

8. Usage Rights & Music Licensing

All raw footage recorded with the camcorder remains the property of the Customer.

The edited highlight video and reels created by the Provider are considered a creative work. The Provider retains the editing copyright to this work.

The Customer receives a non-exclusive, non-transferable license to use the edited video and reels for personal, private purposes only (e.g., sharing with family and friends, posting on personal social media accounts).

The music used in the video is licensed by the Provider strictly for private use. This means the video cannot be used for marketing, advertising, resale, or any other commercial purpose.

Any commercial exploitation (including but not limited to brand collaborations, influencer ads, company promotion) is prohibited unless expressly agreed in writing and subject to additional licensing fees.

The Provider may use short, anonymized excerpts (without identifiable guests) for promotional purposes, unless the Customer objects in writing at the time of booking.

9. Customer Responsibilities

The Customer must handle the camcorder responsibly and avoid exposing it to conditions that could cause damage (e.g., water, extreme heat, impact).

The Customer must ensure all guests are aware that video recordings are being made for private purposes.

The Customer grants the Provider permission to edit the recordings and deliver the final video.

10. Cancellation & Withdrawal

Cancellations up to 3 Month before the event date: 50% refund.

Cancellations within 3 Month before the event: no refund.

If the Provider cannot deliver due to illness, technical failure, or force majeure, the Customer will receive a full refund. No further claims exist.

11. Liability

The Provider is only liable for intent and gross negligence.

Liability for lost data, missed moments, insufficient footage, or dissatisfaction with artistic style is excluded, provided the agreed services are delivered.

12. Final Provisions

German law applies; the place of jurisdiction is the Provider’s registered office.

Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall not be affected.
